This Subscriber Service Agreement (“Agreement”) is entered into between the subscriber (“You”, “User”, “Member” or “Customer”) and Care247, a product line of GreenVayu Innovations Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at PLT NO. TH3, AAKASH GANGA, E8 SHAHPURA, Trilanga, Huzur,
Bhopal- 462039, Madhya Pradesh, hereinafter referred to as “Care247”, “Care247.in “, “CARE247”, “We”, “Us” or “Our” and which expression shall, unless it be repugnant to the context or meaning thereof, be deemed to mean and include all its successors, affiliates and permitted assigns.
By registering for, accessing, or using any service via Care247.in or its affiliated platforms, you agree to the terms of this Agreement, which governs the nature, scope, and limitations of your relationship with Care247.
1.1. “Platform” refers to all digital interfaces and communication channels operated by Care247, including but not limited to the website, mobile applications, WhatsApp, telephonic assistance, and social media platforms.
1.2. “Services” means the healthcare services delivered and coordinated by Care247, including medical consultations, doctor home visits, nursing, caregiving, diagnostics, physiotherapy, hospital assistance, emergency coordination and wellness-related care through physical, virtual or hybrid delivery models.
1.3. “External Healthcare Entities” also referred to as “Partners”, include all independent healthcare and medical professionals, institutions, and service agencies such as emergency responders, ambulance providers, doctors, hospitals, homecare agencies, diagnostic labs, physiotherapists, psychologists, dieticians, and wellness coaches, among others, listed or connected via the Care247 Platform.
1.4 “Website” shall mean the websites operated by Care247, including but not limited to www.care247.in and www.care247.life, as well as any other software, Website/Application, or digital platform provided or authorized by Care247 that facilitates access to its services. This shall also include any other domain or URL as may be notified or specified by Care247 from time to time.
2.1. Care247 delivers coordinated healthcare services through an integrated care model, supporting patients across medical consultations, treatment, home-based healthcare, diagnostics, recovery and emergency assistance.
2.2. Services may be delivered physically, virtually, or as a combination of both, depending on user needs, availability, and practicality.
2.3. Care247 follows structured processes for healthcare coordination, professional verification, service oversight and patient support to maintain consistent standards of care and service quality.
3.1. Care247 operates through a coordinated healthcare delivery model supported by qualified medical professionals and healthcare personnel.
3.2. Medical consultations, assessments and treatment are provided by appropriately qualified and licensed healthcare professionals within their respective scopes of practice.
3.3. Care247 follows structured processes for patient intake, care coordination, appointment management, follow-ups and continuity of care.
3.4. Certain healthcare services may involve external hospitals, diagnostic facilities and independent healthcare professionals where required for patient care. Such arrangements are managed in accordance with applicable service terms and responsibilities.
By using the Website, Applications, Phone lines and other communication Tools/ Software, you agree that:
5.1. Care247’s responsibilities and liabilities shall be determined in accordance with its role in delivering and coordinating healthcare services. This includes responsibility for its own acts, omissions, operational processes and obligations under applicable law.
Where independent healthcare professionals or external institutions are involved, their respective professional and legal responsibilities shall remain applicable.
5.2. Care247 follows professional verification and onboarding processes for healthcare professionals involved in its services. Medical professionals remain responsible for exercising independent clinical judgment and providing care within their qualifications and scope of practice.
5.3. Medical decisions, diagnosis and treatment are undertaken by appropriately qualified healthcare professionals. Care247’s responsibilities and liabilities shall be determined by its actual role, contractual obligations and applicable laws.
6.1. Care247 supports emergency response through structured emergency coordination, assistance with hospital access and arrangements for medical interventions. Care247 recognises and respects the Good Samaritan guidelines applicable in India.
6.2. As per the Supreme Court’s judgment dated March 30, 2016, individuals (including Care247 staff, associates, or agents) who render emergency assistance in good faith to accident or trauma victims shall not be held liable in any civil or criminal proceeding, as long as:
6.3. Care247 coordinates such responses under the principle of Good Samaritan protection, and encourages prompt reporting and assistance in emergencies without fear of harassment or legal repercussions.
6.4. By using the emergency features of Care247, you acknowledge and agree that any individual or entity responding to your emergency is acting in good faith, and shall not be held liable unless gross negligence or deliberate harm is proven.
Care247 and GreenVayu Innovations Private Limited shall be entitled to appropriate protection against claims arising from a user’s misuse of services, breach of this Agreement, fraudulent activities or violation of applicable laws. This protection shall extend to their respective founders, directors, employees and representatives, to the extent permitted under applicable law.
(a) your access to or use of the Services of Care247 or its Third party providers or partners
(b) your breach or alleged breach of these Terms of Use; or
(c) your violation of any applicable law, regulation, or third-party rights, including intellectual property or privacy rights.
This indemnity obligation will survive the termination or expiration of these Terms and your use of the Services.
You agree that Care247.in may contact you via email, SMS, phone calls, push notifications, or by posting notices on its website or app (when live). These communications may include account updates, changes to the app or its features, and health-related notifications, including those from authorized service providers as outlined in the Privacy Policy.
By using the Care247.in website or app, you consent to receive such communications and acknowledge that they satisfy any legal requirement for written communication.
9.1. Applicable healthcare service fees and membership charges shall be communicated to subscribers before confirmation. Payments may be collected by Care247 or, where applicable, through authorised external healthcare facilities.
9.2. Care247 will communicate applicable charges for healthcare services and membership plans transparently. Any additional charges arising from external healthcare facilities will be communicated wherever applicable.
9.3. Care247 shall address payment-related concerns arising from transactions processed directly through its systems. Issues relating to payments made directly to external institutions shall be handled in accordance with the applicable payment arrangements.
10.1. Modes of Payment
Subscribers may pay applicable membership fees and healthcare service charges through the payment methods made available by Care247.
10.2. Additional Charges
In the case of E-Wallet payments, any additional charges not covered by the membership—such as charges for medications, equipment, or emergency services—must be paid by you in cash directly to the concerned authority, caregiver, ambulance provider, or healthcare facility.
10.3. Non-Refundable Payments
Payments, cancellations and refunds shall be governed by Care247’s Refund and Cancellation Policy. Refund eligibility will depend on the nature of the service, payment status and applicable cancellation conditions.
10.4. Taxes
All applicable taxes on the service fee shall be borne and paid by you. Care247 shall be entitled to collect and remit such taxes as per applicable law.
10.5. Receipt and Invoices
A receipt for the service fee will be provided to you at the end of each service. You may also request copies of past invoices through your Care247 account.
10.6. Payment Disputes
Payment-related concerns may be raised with Care247 through its designated support channels. Transactions processed through external payment processors shall also be subject to applicable processor terms.
11.1. You consent to the collection, use, and sharing of your personal, health, and communication data by Care247 in accordance with applicable Indian data protection laws, including the Information Technology Act, 2000 and its allied rules.
11.2. Your personal and health information may be processed by Care247 for providing healthcare services, maintaining patient records, coordinating treatment, managing follow-ups and ensuring continuity of care. Information may be shared with authorised healthcare professionals and institutions where necessary for these purposes and in accordance with applicable law.
11.3. Care247 implements reasonable technical and organisational safeguards to protect personal and health information in accordance with applicable data protection requirements
11.4. By using the Services, you consent to:
11.5. You retain the right to decline any treatment, advice, or service offered by a third party.
11.6.Have this clause reviewed by legal counsel. Its current blanket exclusion of liability for personal injury or death should not be retained without legal review.
12.1. Care247.in and its licensors, where applicable, shall retain exclusive ownership of all rights, title, and interest, including all intellectual property rights, in and to the software, website/application, and the services provided thereon, including but not limited to their components, processes, functionality, design, and content.
12.2. Any suggestions, feedback, ideas, or other information you provide relating to the services shall be deemed to be voluntarily submitted and shall become the sole and exclusive property of Care247.in, without any obligation to compensate you.
12.3. These Terms of Use do not constitute a sale and do not grant you any ownership rights, license, or interest in the software, website/application, or any related intellectual property rights owned by Care247.in or its licensors.
12.4. The name “Care247.in,” the Care247.in logo, and any other trademarks, service marks, trade names, or logos used in connection with the software or website/application are the intellectual property of Care247.in or its respective third-party owners. No right or license is granted to use any of these marks without prior written consent.
13.1. You agree to provide accurate and complete information for the provision of services.
13.2. You shall not misuse emergency features or make false requests.
13.3. You are responsible for providing accurate health information, following prescribed medical advice and making informed decisions regarding your healthcare in consultation with qualified medical professionals.
You acknowledge use of google map services to locate you your primary residence or secondary location are provided via the Google Maps API by Google Inc., located at 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. By downloading, installing, or using the Care247.in to accurately determine service location for you, you agree to be bound by Google’s Terms of Use, available at http://maps.google.com/help/terms_maps.html.
It is solely your responsibility to review, assess, and comply with Google’s Terms of Service, as may be updated from time to time. Care247.in shall not be held liable for any loss, damage, or other consequences arising from your use of or reliance on the mapping and navigation services provided by Google Maps.
15.1. Either party may terminate this Agreement by written notice or cessation of service usage. Any termination shall not affect rights or liabilities accrued prior to the termination.
15.2. Care247 reserves the right to suspend or discontinue services for misuse, non-compliance with terms, or any unlawful activity.
16.1. This Agreement shall be governed by and interpreted in accordance with the laws of India.
16.2. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of courts in Bhopal, MP, India.
16.3. Parties shall make best efforts to resolve disputes through mutual consultation and mediation before initiating legal proceedings.
17.1. This Agreement constitutes the entire agreement between the parties and supersedes all prior understandings.
17.2. Care247 may update these terms from time to time. Continued use of the Care247.in Platform indicates your acceptance of any updated terms.
17.3. If any provision of this Agreement is held invalid, the remaining provisions shall remain enforceable.
